A government entity may be liable for injury to a car accident. Oklahoma permits victims of injury to file claims for damages against the Government. Specific requirements exist however, and government bodies and officers may be subject to certain types of claims immunity. The good news is that the victim must have usually been negligent and not allowed to file a claim.

Why Government Could Be Liable Car Accident?

Although government entities usually have no liability, a government entity or public servant is liable for damage caused by a car accident in numerous instances. For example, for an accident caused by any of the following, the government is liable:

  • Sighting obstruction of the driver

  • Roadside hazards

  • Wrongly marked construction zone

  • Railway grade crossing that is unreasonably dangerous

Time to Claim

Claims of a state government entity in Oklahoma have to be filed within 180 days of the date of injury. A claim should name the agency you are opposing or the written claim should mention the agency you have an allegation against. It will include description of the incident, how it happened, the amount of claim demanded and the evidence made.

The government has 60 days to reply. If you do not receive a response within 60 days, your claim may seem to be denied. If that happens, you are allowed to file a lawsuit hiring a car wreck attorney.

In the case of small children or a victim who has been determined to be incompetent in court, the 180-day period for filing a claim may differ. Where one of them applies to the victim, after 18 years of age or when the court is responsible, the victim must file a complaint for 180 days.
